LAS 34675 Notice of Water Right Application
NOTICE OF WATER RIGHT APPLICATION
LAS 34675
Pursuant to AS 46.15.133 and 11 AAC 93.080, notice is hereby given that Elman Anchorage Associates Limited Partnership, 1011 E Tudor Rd, Su 100, Anchorage AK 99502 applied for a water right on July 7, 2024 (Priority Date). The application proposes water withdrawals associated with a cooling well to service a new commercial building in the Central City Subdivision in Anchorage. Water will be discharged into Fish Creek as part of the municipal storm drain system. This request is currently under Temporary Water Use Authorization (TWUA) A2023-81, which is attached to this notice.
Amount of Water: The daily withdrawal is limited to 864,000 gallons, with a combined yearly limit not to exceed 315,360,000 gallons.
Withdrawal Location: Existing well, 305' in depth (screened to 277' to 297.5' in depth), in Lot 8C, Tudor Corner Subdivision, filed under Plat Number 95-26, Anchorage Recording District (MOA parcel ID 00912231000).
Water Use Area: Fragment Lot 3, Central City Subdivision, according to the Commercial Tract Site Plan, filed under Plat No. 85-107, which lies within Tract A-2, Central City Subdivision; and 1101 E Tudor Road (MOA parcel IDs 00912233000 and 00912219000).
Discharge Location: Fish Creek via the storm drain system at E 42nd Place in Fragment Lot 3, Tract A-2, Central City Subdivision (MOA parcel ID 00912233000).
Per AS 46.15.133(a), within 15 days of publication or service of notice, persons may file with the director written objections. Comments or objections must be made in writing by email to [email protected] or by mail to Alaska Department of Natural Resources, Water Resources Section, 550 W 7th Ave, Suite 1020, Anchorage, Alaska 99501-3562 by 5:00 p.m. September 4, 2025. Pursuant to 11 AAC 93.080(6), "The public comment period set by AS 46.15.133 (c) begins the first day the newspaper publication appears, or the first day of posting, or upon receipt of the notice as evidenced by the certified mail receipt, date stamp, or other evidence of actual service."
Objections must include the objector's name and address, and any facts tending to show that the rights of the objector or the public interest would be adversely affected by the proposed appropriation. For more information, please contact Lesli Schick at [email protected]
