Senator Marshall Joins Colleagues Calling for DOJ Investigation into Fraudulent Obamacare Subsidies

Washington - U.S. Senator Roger Marshall, M.D. (R-Kansas), joined Republican colleagues in a letter led by Senator John Cornyn (R-Texas) urging the Department of Justice (DOJ) to investigate and recover Obamacare subsidy payments made to insurance companies during the Biden administration that stemmed from fraudulent, unauthorized, or improper enrollments - ensuring taxpayer dollars are not lost to waste, fraud, and abuse.

In the letter to the DOJ, the Senators wrote:

"Every improper enrollment in an ACA marketplace plan directly harms the American taxpayer. When fraudulent or unauthorized enrollments occur, brokers receive commissions and insurance companies receive federal subsidy payments - even when the consumer never consented to coverage."

"Between January and August 2024 alone, CMS received approximately 275,000 complaints from consumers who were enrolled in a plan or had their coverage changed without their consent. These schemes have already cost taxpayers hundreds of millions of dollars, including cases involving more than $180 million in improper subsidy payments."

"The Government Accountability Office has confirmed that significant fraud risks remain. Most concerning, GAO could not identify evidence of reconciliation for more than $21 billion in ACA marketplace subsidies in tax year 2023."

"The Department of Justice has a responsibility to ensure taxpayer funds are not misused. I urge DOJ to pursue all available civil remedies to recover subsidy payments made to insurance companies as a result of waste, fraud, and abuse."
