NOTICE OF PROPOSED CHANGES ON COMMUNITY ENERGY FACILITIES
IN THE REGULATIONS OF THE REGULATORY COMMISSION OF ALASKA

Summary of proposed changes: The Regulatory Commission of Alaska (RCA) proposes regulation changes in Title 3 of the Alaska Administrative Code related to community energy facilities and in response to recent changes in statute at AS 42.05.725 - AS 42.05.735. Specifically, the proposed regulation changes implement a community energy program allowing small-scale renewable community energy generation facilities to be integrated into the generation portfolio of electric utilities.

Written comments: You may comment on the proposed regulations changes, including the potential costs to private persons of complying with the proposed changes, by submitting written comments to the RCA at 701 W. 8th Ave, Ste 300, Anchorage, AK 99501. Additionally, the RCA will accept comments at: https://rca.alaska.gov/RCAWeb/WhatsNew/PublicNoticesComments.aspx. Comments may also be submitted through the Alaska Online Public Notice System, by accessing this notice on the system and using the comment link. The comments must be received not later than 5 p.m. on October 30, 2025. Since this is a regulation proceeding, commenters are not required to serve their comments on other entities or persons set out on the service list of this notice.

Public nature of comments: Public comments, once submitted, are public records and subject to disclosure under the Alaska Public Records Act. See AS 40.25.100 - 40.25.295. Do NOT include in your comments any information that you do not want made public.

Final version of regulations: After the public comment period ends, the RCA will either adopt the proposed regulation changes or other provisions dealing with the same subject, without further notice, or decide to take no action. The language of the final regulation may be different from that of the proposed regulation. You should comment during the time allowed if your interests could be affected.
