Líderes globais unidos em defesa do direito internacional humanitário para preservar a humanidade em tempos de guerra

Alarmados pelas amplas violações do direito internacional humanitário (DIH) em conflitos ao redor do mundo e pelo inconcebível sofrimento humano que disso resulta, nós, os líderes do Brasil, China, França, Jordânia, Cazaquistão e África do Sul exortamos os Estados e a comunidade internacional a agir.

Há um ano, lançamos a "Iniciativa Global para Galvanizar o Compromisso Político com o DIH". Fomos motivados por um profundo senso de responsabilidade e pela urgência de agir, de maneira decisiva, para conter a onda de violações ao direito internacional humanitário que o mundo tem testemunhado.

Até o momento, 89 Estados de todas as regiões do mundo aderiram formalmente à Iniciativa Global para preservar a humanidade em tempos de guerra. Vinte e sete Estados estão co-liderando sete áreas temáticas de trabalho, voltadas a desenvolver recomendações práticas sobre como ampliar o cumprimento do DIH e enfrentar os desafios impostos pelas evoluções nos meios e métodos de guerra atualmente.

No último ano, mais de 130 Estados participaram de consultas globais e regionais sobre como melhorar o cumprimento do DIH. Tema comum dessas conversas foi o apelo dos Estados por uma interpretação mais protetiva do direito internacional humanitário. As conclusões dessas consultas serão publicadas em um relatório preliminar, no próximo mês.

A Iniciativa Global sobre o DIH trata de todos os conflitos ao redor do mundo, dirige-se a todos os atores relevantes e busca assegurar uma aplicação uniforme e universal do DIH. Reconhece, ainda, que a responsabilidade primária pelo respeito, implementação e aplicação prática das Convenções de Genebra recai sobre os Estados.

Conclamamos, portanto, todas as partes de conflitos armados a respeitar o DIH. Reafirmamos que todos os Estados, inclusive em situações de ocupação, estão obrigados a respeitar e a fazer respeitar o direito internacional humanitário de maneira plena, o que inclui normas relativas à proteção de pessoas e objetos civis, pessoal médico e humanitário, além de jornalistas. As Nações Unidas, em conformidade com a Carta da ONU, assim como o sistema multilateral com um todo têm um importante papel a desempenhar nessa tarefa.

Hoje, anunciamos que iremos co-organizar uma reunião global de alto nível para preservar a humanidade em tempos de guerra, em 2026.

À medida que nos aproximamos desse encontro, pedimos a todos os Estados que considerem:

• Começar pela aplicação do DIH em âmbito nacional, ao alocar, oficialmente, recursos adequados para investir e assegurar o cumprimento com o DIH, inclusive em conflitos em curso.
• Avançar na integração do DIH na legislação nacional e no preparo para atuação em conflitos, por meio, por exemplo, de treinamento adequado das forças armadas e de segurança, bem como do fortalecimento de comissões nacionais de DIH.
• Aderir formalmente à Iniciativa Global sobre o DIH, participar ativamente das consultas e incentivar outros a fazer o mesmo.

Setenta e seis anos após a adoção das Convenções de Genebra, conclamamos todos os líderes mundiais a se unirem em torno de uma responsabilidade comum: prevenir atrocidades e proteger a humanidade em tempos de guerra. O mundo não pode permanecer inerte enquanto os princípios básicos do direito internacional humanitário são rotineira e deliberadamente violados. Juntos, podemos pôr fim ao inconcebível e inaceitável sofrimento e destruição que marcam os conflitos atuais e direcioná-los rumo à resolução pacífica.

World leaders united in defence of international humanitarian law to uphold humanity in war

Alarmed by widespread violations of international humanitarian law (IHL) in conflicts around the world and the resulting unconscionable human suffering, we, the leaders of Brazil, China, France, Jordan, Kazakhstan and South Africa, together with the International Committee of the Red Cross (ICRC), urge States and the international community to act.

A year ago, we launched the Global Initiative to galvanize political commitment for IHL. We were driven by a deep sense of responsibility and urgency to act decisively to stem the tide of violations of international humanitarian law the world is witnessing.

To date, 89 states from all regions of the world have formally joined the Global IHL Initiative to uphold humanity in war. Twenty-seven states are co-leading seven thematic workstreams to develop practical recommendations on how to increase compliance with IHL and address challenges posed by contemporary evolutions of warfare.

Over the last year, more than 130 states participated in global and regional consultations on how to improve compliance with IHL. A common theme emerging from these consultations is a call from states for a protective interpretation of IHL. Findings will be published in an interim report next month.

The Global IHL Initiative speaks to all conflicts around the world, addresses all relevant stakeholders, and seeks to ensure an even and universal application of IHL. It also recognizes that the primary responsibility to uphold, implement, and apply the Geneva Conventions in practice lies with States.

We therefore call on all parties to armed conflict to uphold IHL. We reaffirm that all states, including in situations of occupation, are bound to fully respect and ensure respect for international humanitarian law, including the rules related to the protection of civilians, civilian objects, medical and aid workers, and journalists. The United Nations, in line with the UN Charter, and the wider multilateral system play an important role in this regard.

Today we announce that we will co-host a global high-level meeting to uphold humanity in war in 2026.

In the lead up to the meeting, we ask all states to consider:

• Starting with IHL at home, by officially allocating adequate resources to invest in and ensure compliance with IHL, including in ongoing conflicts.
• Advancing the integration of IHL into national legislation and conflict preparedness, by means such as adequate training of military and security forces, and through empowering national IHL committees.
• Formally joining the Global IHL Initiative, engaging actively in the consultations, and encouraging others to do the same.

Seventy-six years after the adoption of the Geneva Conventions, we call on all world leaders to unite around a shared responsibility: to prevent atrocities and protect humanity in times of war. The world cannot stand idly as the basic tenets of international humanitarian law are routinely and deliberately being violated. Together, we can put an end to the inconceivable and unconscionable suffering and destruction that is the mark of today's conflicts, and steer the latter towards peaceful resolution.
