Jeffrey Gary Sentenced on Abduction and Sexual Battery

For Immediate Release: March 24, 2026

On March 20, 2026, Jeffrey Thomas Gary, a 35-year-old resident of Fairfax County, was sentenced by the Alexandria Circuit Court to one year of active incarceration after pleading guilty to two felony counts of Abduction and one misdemeanor count of Sexual Battery.

The defendant's pleas of guilty were founded on the following statement of facts, which summarizes the evidence the Commonwealth would have established at trial and which was read in the official record of the case.

The charges arose from an investigation into the report of two separate attacks committed against women at Metro stations in the City of Alexandria on May 30, 2025. Video evidence and police interviews established what occurred.

At approximately 8:55 p.m.., the defendant approached the first victim at the Potomac Yard Metro station after watching her for several minutes as she waited with her young daughter. While the defendant observed the victim, he repeatedly placed his hands in and around his pants. He grabbed the victim and forced her to the ground, groping her over her clothing before fleeing when her daughter intervened by dumping her juice box on him. Upon seeing a Metro employee approaching, the defendant exited the Metro platform but later returned and followed the victim to a bus stop where he persisted in trying to pull her away as she sought help from a passerby. The defendant eventually stopped the assault and got back on a southbound Metro train.

The defendant exited the train at the Braddock Road Metro and waited on the platform near the top of the escalator. As the second victim walked past him and got on an escalator around 9:37 p.m., the defendant turned and followed her. He walked behind her out of the Metro station and followed as she crossed the street. The defendant walked parallel to her on the opposite side of the street before crossing the street and attacking her from behind. He placed his hand over her mouth and his other arm around her waist. As the victim struggled against him, the two fell to the ground, where he kept a strong hold on her and kept his hand over her mouth. The victim was able to break free and ran away screaming. She called the police once she was a safe distance away. The defendant was apprehended the following day after the Metro Transit Police Department identified him by the use of his SmartTrip card and corroborating video surveillance.

On both counts of felony Abduction, the Court sentenced the defendant to 10 years of incarceration, with all but 1 year of that sentence suspended on the conditions outlined below. On the misdemeanor Sexual Battery charge, the Court sentenced the defendant to 12 months in jail, with all of that sentence suspended upon the conditions outlined below. The Court ordered all three sentences to run concurrently, resulting in a total sentence of 10 years of incarceration, with all but 1 year of that sentence suspended for the period of 10 years, and upon the following conditions: the defendant's uniform good behavior, his compliance with supervised probation for the period of 5 years, to include compliance with mental health and substance abuse treatment, and his payment of the costs of his prosecution. The Court also entered a lifetime protective order prohibiting the defendant from contacting either victim.

The matter was prosecuted by Deputy Commonwealth's Attorney Jessica Best Smith and Assistant Commonwealth's Attorney Harsh Voruganti. The cases were investigated by Detective Richard Keenen and Detective Kelvin Rodriguez of the Metro Transit Police Department and Detective Kristina Loerch of the Alexandria Police Department.

Alexandria Commonwealth's Attorney Bryan Porter said: "This offense involved every citizen's nightmare: a nighttime attack on a victim apparently selected at random. My office argued for an active sentence of 5 years. While I understand that sentencing hearings are difficult and the Court must weigh competing factors in arriving at a just sentence, I am disappointed that the sentence imposed by the Court was less than that sought by my office, and I am concerned about the defendant's danger of reoffending upon his release from incarceration."

"My thoughts are with the survivors of these offenses. While a successful prosecution cannot address the immense impact of the crimes at issue, I sincerely hope that it might offer some solace and a chance for the survivors to move forward."

The defendant is currently held in the Alexandria Adult Detention Center and he will conclude the service of his sentence in that facility.
