CHPA Urges Continued Modernization as FDA Signals Update to DSHEA Labeling Requirements

(WASHINGTON, D.C.) - The Consumer Healthcare Products Association (CHPA) today released the below statement following the U.S. Food and Drug Administration's (FDA) decisionto exercise enforcement discretion regarding the placement of the Dietary Supplement Health and Education Act (DSHEA) disclaimer and its indication that the Agency is likely to propose a rule to formally update the requirement:

"For years, CHPA has called on FDA to modernize DSHEA implementation in ways that preserve consumer protections while eliminating outdated requirements that add cost and complexity without improving consumer clarity or strengthening FDA oversight," said CHPA SVP of Dietary Supplements Duffy MacKay. "FDA's decision reflects a careful review of the statute, real-world labeling practices, and enforcement history, and it represents meaningful progress toward a more modern, workable regulatory framework."

"Modernizing DSHEA is not about weakening standards, it's about ensuring regulations are clear, enforceable, and consistently applied, and focused on outcomes that matter for consumers. Background:

In a letterissued to dietary supplement manufacturers, distributors, and retailers, FDA announced it will not require the DSHEA disclaimer to appear on every label panel where a structure/function claim is made, provided the disclaimer appears on the label and is clearly linked to each claim. FDA also stated that, based on its initial review, removing the "each panel" requirement would be consistent with DSHEA while reducing label clutter and unnecessary costs that do not improve public health.
