ANACOM fines MEO for breaching the rules governing the construction, access to, and installation of networks and infrastructure

ANACOM imposed a one-off fine of EUR 87,500 on MEO - Serviços de Comunicações e Multimédia, S.A., for breaching the provisions of Decree-Law No. 123/2009, of 21 May. Specifically, MEO was found to have breached the following:

  • 1 failure to comply with the obligation to use existing telecommunications infrastructure where such infrastructure is capable of supporting the services and technology in question;
  • 1 failure to comply with the obligation not to occupy spaces and ducts in a manner that is not justified by the services and technology in question;
  • 1 failure to comply with the obligation not to hinder or prevent, directly or indirectly, the use of the infrastructure by other electronic communications companies;
  • 1 failure to comply with the obligation not to connect telecommunications infrastructure in buildings to the public communications network before a certificate of responsibility for the installation has been issued.

The defendant has appealed against this decision in the Court of Competition, Regulation and Supervision.
