BNC UPDATE - PROCESSING RESUMED

Monday, October 26, 2026

The judiciary received notice that the Bankruptcy Noticing Center (BNC) has resumed operations. The BNC is working to simultaneously transmit the backlog created by the disruption for documents to be noticed by the BNC since on or about October 6, 2026, and resume service of newly filed notices and orders. Processing the backlog is occurring in phases and may not be completed for several days. The Court continues to monitor docket activity for impacted cases to confirm the BNC is functioning as anticipated. The BNC will notify the courts once the backlog is completed. To ensure adequate service, parties are advised to continue following the Additional Notice Delegations set forth in Operating Order 26-03: Notice Disruption Due to Bankruptcy Noticing Center Outage and Temporary Delegation of Additional Notices and Service of Orders until further notice from the Court.

The Court understands that in attempts to mitigate the issue of notices having become stale during the disruption, transmissions will include a message on the address page as follows:

IMPORTANT NOTICE: The enclosed notice(s) may have been sent later than intended because of a service disruption affecting the Bankruptcy Noticing Center. The information in this notice is still valid, but because of the delay, a deadline or response period listed here may have passed and you may receive an amended notice. Should you have questions regarding a deadline or a response period, please contact your attorney or visit the website of the clerk's office of the court named on this notice.

Further, the Judicial Conference of the United States declared a "Bankruptcy Rules emergency" under Fed. R. Bankr. P. 9038. The declaration grants authority to chief bankruptcy judges to act as authorized by Fed. R. Bankr. P. 9038(c) to extend or toll time limits set by a Bankruptcy Rule, local rule, or order on a district-wide basis, or to the presiding judge to do so in a specific case or proceeding. The Court will utilize this emergency authority to address any harm caused by stale notices as necessary and will issue additional orders and notices as needed.
