Illegal Alien Sentenced to Three Years in Prison for Assaulting Immigration Officer

Yakima, Washington - First Assistant United States Attorney Pete Serrano announced that on October 7, 2026, Alfredo Gallegos Guillen ("Guillen"), age 31, an illegal alien from Mexico, was sentenced by Chief District Court Judge Stanley A. Bastian to 36 months imprisonment to be followed by three years of supervised release.

According to court documents, in 2023, Guillen was charged in the State of Idaho with multiple criminal offenses. Guillen failed to appear for court hearings and warrants were issued for his arrest. While on warrant status, Guillen was arrested and convicted in Washington State for Driving under the Influence ("DUI"). Guillen was sentenced to 20 days in jail and five years of probation. Washington State authorities terminated Guillen's probation early. Subsequent to his DUI conviction, Guillen was arrested in Washington State for Domestic Violence, Violation of a Protection order, and Resisting Arrest. Guillen was ultimately released from state custody. Federal law enforcement officers learned that Guillen was a Mexican national and that a Federal administrative immigration warrant had been issued for his arrest.

On April 20, 2026, Enforcement and Removal Operations ("ERO") officers and other federal law enforcement agents, traveled to a residence located in Toppenish, Washington, where Guillen was believed to reside. The officers observed Guillen's vehicle parked outside. The officers were aware that Guillen had previously been arrested in the same vehicle by Washington State law enforcement officers. Guillen subsequently exited the residence, entered his vehicle, and departed from the location. The officers activated their red and blue emergency lights and surrounded Guillen's vehicle. Guillen stopped his vehicle and turned off his ignition. The Federal officers, who were all wearing official law enforcement uniforms, approached the vehicle to speak to Guillen. Guillen produced his Mexican identification card. The officers confirmed that multiple arrest warrants had been issued for Guillen. The officers instructed Guillen to exit the vehicle. Guillen refused to comply with the instructions. Ultimately, an ERO officer put his arm in the passenger side window, unlocked the door, and entered the vehicle. In response, Guillen placed himself and the officers in imminent danger by turning on the ignition and quickly accelerating. Guillen was aware that the ERO officer was partially inside of his vehicle on the passenger side. Guillen swerved his vehicle and struck a parked car on his passenger side door. Guillen was fully aware that the ERO officer would be injured due to the collision with the parked car. Due to the force of the collision, the ERO officer was injured. Guillen then slammed his vehicle into a utility pole, exited the vehicle, and attempted to flee on foot. Guillen was quickly apprehended.

Guillen was federally charged with Assaulting, Resisting, and/or Impeding these Officers. On July 8, 2026, Guillen pled guilty to the Indictment and on October 7, 2026, Guillen appeared before Chief Judge Stanley A. Bastian for his sentencing hearing. Chief Judge Bastian sentenced Guillen to a term of three years imprisonment to be followed by three years of supervised release.

"Assaults on law enforcement officers are an attack on the rule of law and a threat to safety and peace of our communities," stated Serrano. "These agents were simply carrying out the job they had sworn to do and Guillen sought to harm them to avoid apprehension. Targeting law enforcement is dangerous trend that will not be tolerated -- my message is simple: don't do it. I'm grateful to the officers who risk their lives to protect our communities; my office will continue to stand with them by prosecuting individuals, like Guillen, who seek to harm them."

This case was investigated by the Department of Homeland Security, Homeland Security Investigations and Immigration and Customs Enforcement. The case was prosecuted by Assistant United States Attorney Tom Hanlon.
